These Terms of Service govern your use of wuffytails.com and any purchase you make from us. By using the site or placing an order you agree to these terms. If you do not agree, please do not use the site.

WuffyTails is operated by Herzu Americas LLC, a California limited liability company, with its principal place of business at 1025 W 70th St, Los Angeles, CA 90044.

1. Who may use the store

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the payment method you use is yours and that the information you give us is accurate.

2. Products, descriptions and pricing

We work hard to describe our products accurately and to show colours faithfully, but screens vary and small variations in colour and finish are normal.

All prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable. We may change prices at any time before you place an order. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full; we will contact you first.

Where we show a comparison ("was") price, that price was the prevailing market price for the item within the three months immediately preceding the advertisement; where it was not, we state clearly and conspicuously the date on which that price did prevail. This follows California Business and Professions Code § 17501. Discounts and promotional codes cannot be combined unless we say so, and they may be withdrawn at any time.

2b. Product warranties

Goods sold to California consumers carry the implied warranties of merchantability and, where applicable, fitness for a particular purpose under the Song-Beverly Consumer Warranty Act. Nothing in these terms waives those implied warranties. If a product is faulty, see our Refund & Return Policy.

2c. Proposition 65

California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65, California Health and Safety Code § 25249.6) requires a clear and reasonable warning before a California consumer is exposed to a listed chemical. Where a warning is required for a product we sell, that warning appears on the product's page before you complete your purchase, and on the product or its packaging. If you have a question about a specific item, email us at info@wuffytails.com before ordering and we will check with the supplier.

2d. Gift cards

Gift cards sold by WuffyTails do not expire and carry no dormancy or service fees, in line with California Civil Code § 1749.5. Gift cards are not redeemable for cash except where required by law.

3. Product safety and intended use

Our products are accessories for dogs. They are not medical or veterinary devices and are not intended to diagnose, treat, cure or prevent any condition. No toy or accessory is indestructible: supervise your dog, check items regularly for wear, and stop using anything that becomes damaged. Follow any size guidance on the product page. If your dog has a health concern, talk to your veterinarian.

4. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a dispatch confirmation. We may refuse or cancel an order — for example if an item is out of stock, if we suspect fraud, or if there was a pricing error. If we cancel an order you have paid for, we refund you in full.

5. Shipping, returns and refunds

Shipping is governed by our Shipping Policy and returns by our Refund & Return Policy. Both form part of these terms.

6. Accounts

If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us immediately at info@wuffytails.com if you suspect unauthorised use.

7. Reviews and content you submit

If you submit a review, photo or comment, you confirm it is your own honest experience and that you own the rights to it. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our store and marketing. We may decline or remove content that is unlawful, abusive, misleading, or not a genuine customer experience. We do not pay for reviews or alter their substance.

8. Intellectual property

The WuffyTails name, logo, site design, text, graphics and photography are owned by us or our licensors and are protected by intellectual property law. You may not copy, reproduce or use them commercially without our written permission.

9. Acceptable use

You agree not to use the store to break the law, to introduce malicious code, to scrape or harvest data without permission, to interfere with the site's operation, or to infringe anyone's rights.

10. Third-party services and links

The store runs on Shopify and uses third-party payment, shipping, analytics and advertising providers. Links to third-party sites are provided for convenience; we do not control them and are not responsible for their content or policies.

11. Disclaimers

The site is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, WuffyTails and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these terms excludes liability that cannot be excluded by law.

13. Indemnity

You agree to indemnify WuffyTails against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site.

14. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Nothing in these terms requires you to give up any right you have under California consumer protection law, including your rights under the Consumers Legal Remedies Act.

15. Changes to these terms

We may update these terms. The version in force is the one published here when you place your order. Material changes will be signalled by updating the "Last updated" date above.
